State Ban/National Ban

So they just banned all vape products in my state the other day with absolutely no warning whatsoever, it literally happened overnight. This made me realize that they could do the exact same thing with Kratom if they so desired. I've always been under the impression that if there ever was a ban we'd all have some sort of advanced notice allowing us to stock up and prepare. Apparently that's not the case, at least not on the state level anyway. They can ban ANY product they feel is a direct risk to public health, and they can implement it immediately.

Is this just how it is here in Massachusetts or do all states have the ability to do such a thing? Also can anyone tell me if the same thing could happen on a national level.. just ban something in the blink of an eye with no warning?

Okay, first off Im very sorry this has happened to you!

Secondly, I live in NH right above your state, MA. I have Family in Mass and I actually live in Nashua, NH, (Southern New Hampshire).
I’m very interested in this and it worries me so I need to make more of an effort to stay on top of news like this!

I'm not an expert on your state's politics but my assumption would be MA Department of Health has regulatory authority over tobacco products, similar to how on the Federal level the FDA has control over tobacco. This is why the FDA can (and perhaps will) ban flavored vapes so easily. With scheduling decisions it is a process that involves the HHS, FDA, NIDA and DEA in which case yes we would have another 30 days (if they were to do an emergency schedule again, which most agree seems unlikely), or a period that would take 2 or 3 years (as was the case with MDMA) if they sought permanent schedule 1 status. So I think these scenarios are a little different. Also, look at the vaping situation, there's like what close to a 1000 people in the hospital and 12 dead? The 44 FDA kratom deaths have been thoroughly debunked. Kratom isn't perfect but it's not causing the kind of public health urgency that these black market cartridges are.

There has been MONTHS of warning with these vape products... people getting shit in their lungs.. going to the hospital.. and dead. :shock:

Someone on Reddit is yelling about "Nanny State" blah blah... hey it's not only about YOU. You are not the center of the universe.. It's risk to public health and proven # of hospital cases of people dead and dying!!! Sure its a free country, there is free enterprise - But that makes FDA absolutely necessary, if you think about it... The vape situation is totally different from kratom. :geek:

How about the case of Ephedra ?? I remember when Orioles pitcher Steve Bechler, died and the autopsy revealed a huge load of Ephedra, many athletes were using the stuff - That was the tipping point and they banned Ephedra, a plant with alkaloids - similar to kratom - Big difference was proven medical risk of death. On April 12, 2004, the FDA issued a final rule banning the sale of ephedrine alkaloid dietary supplements. https://en.wikipedia.org/wiki/Ephedra

Just want to clear up that it was not the FDA who implemented this ban, it was MA governor Charlie Baker. Sorry if I made it sound like it was the FDA, it was the local government here in Massachusetts.

I'm not sure how a governor has the power to ban something that the FDA itself regulates, but he did..

Kay Inslee just banned flavor ejuice in the state of wa last night, goes into affect immediately.

That's Jay Inslee. Washington State has legal cannabis industry with licensed weed shops, and THC vape sold in those shops... As of last week: Michigan, New York, and Mass. have all banned flavored vape products. Each state has its own laws... I have heard ZERO about kratom in WA state, and the head-shops are selling a huge variety of shots, extract, vapes, and various "Legal High" products. :geek:
