EXPLANATION**
In the event that the exporter already has a Good Manufacturing Practices (GMP) certificate for the processing facility/factory issued by a certification body, the Self-Declaration Statement (SPM) with a legal stamp, as listed in the requirements column, must be completed with the certificate number.
For the issuance of ETPK and ETNPK recommendations, the agency will conduct field verification.
An exporter can only hold one Registered Exporter license.
The validity period of ETPK and ETNPK lasts as long as the company in question is still conducting export business activities for Kratom.
The issuance of the Export Approval is based on:
a. Commodity Balance, if determined; or
b. Provisions and available data, if the Commodity Balance has not been determined.
The issuance of Export Approval is based on the calculation of the maximum capacity of the milling machine multiplied by the export rights percentage.
The export rights percentage is based on the calculation of the average export price of kratom, stock availability in warehouses, and the demand for kratom from the importing country.
The export rights percentage is determined every six (6) months for the periods January to June and July to December through coordination meetings or at any time based on the proposal of Ministries/Agencies.
The Coordination Meeting is an inter-ministerial/agency meeting organized by the ministry responsible for trade, held in June and December before the implementation period.
The determination of the Kratom Export Rights Percentage is based on data and information from Ministries/Agencies, provincial-level trade authorities, and/or cooperative and/or registered Kratom exporter associations, taking into account:
a. Information on Kratom supply, such as the current Kratom stock data in the warehouse;
b. Information on Kratom import demand from destination countries in the form of unfulfilled purchase order data; and
c. Information on international market prices in the form of a recap of prices in invoices and purchase orders from the past month.
An exporter can only hold one Export Approval.
Kratom Export Approval is valid for one or more submissions of Export Customs Declarations (non-transactional).
The validity of the Kratom Export Approval is a maximum of six (6) months, from January to June or July to December.
The validity period for Kratom Export Approval amendments lasts for the remaining validity period of the original Kratom Export Approval.
Other data in Export Business Licensing in the form of Export Approval can be modified as stipulated in Article 8 paragraph (4), specifically the destination country.
The Surveyor Report must meet the following technical criteria:
1. Free from the mixture of other leaves, as proven by a mitragynine content of ≥ 1.2% for green and white kratom, and ≥ 0.8% for red kratom;
2. Free from heavy metals, as proven by a lead (Pb) content of ≤ 1 mg/kg, mercury (Hg) ≤ 0.5 mg/kg, cadmium (Cd) ≤ 0.3 mg/kg, arsenic (As) ≤ 1.5 mg/kg;
3. Free from bacterial contamination, as proven by a negative result (-) for *Salmonella sp.* and ≤ 10 AM/gram for *Escherichia coli*; and
4. The water content in kratom powder should be ≤ 10%.
The Verification or Technical Tracing request by the exporter is submitted electronically to the Surveyor.
Data elements and/or additional information, other than those regulated in the main body, which are subject to research in accordance with the provisions of the laws and regulations, as included in the Export Surveyor Report and the Export Customs Declaration, include:
a. Destination port; and
b. Destination country.
