Legal Kratom: FDA, Labeling, Medical Claims, NFHC

Opening this BIG discussion regarding current Legal Status of kratom, in particular kratom VENDORS online. What's happening? What is the FDA doing, how is the AKA (American Kratom Association) responding. What are some issues around Retail "head shop" kratom, -vs- Online sales of raw bulk powder? How "should" kratom be SOLD, in stores? On websites? Candle and Soap making? Or Herbal Supplements, how should vendors Import, and market the product in order to stay within the law?
A Michigan man, doing business as Nomad Botanicals, this month was prosecuted by the Feds / and sentenced to 2 Years in Federal Prison. Charges involve mis-labeling, FRAUD, and making Medical Claims on his website. There is a link to Article, and discussion this week on Reddit.
Again, the Nomad guy was NOT prosecuted under State Law.. The State of Michigan, has little to-do with this, as I understand the situation. It was Federal investigators/ Prosecutors who apparently conducted a "sting" and then raided the guy's house.

How does that work? Why that's the standard for online vendors. Who observes that standard now. What should online vendors be doing, to remain fully legal and compliant with current law.
