Re: Interesting Kratom article from Wired
Great read, thanks for sharing! So much of the media coverage doesn't include quotes from scientists saying "I’m not convinced that a single death has been the result of kratom."
I'm curious how much of an issue adulterants are in reality. Kratom is so cheap as it is, can't imagine it being very profitable to "cut" with potato starch or macha.

Here's another article about Faith Day from last week that discusses the Oregon Department or Agriculture licensing aspect a bit more.

A kratom processor may not prepare, distribute, sell or offer for sale a kratom product that is not registered with the department as described in this section.
Question: Which Vendors WILL defy this Law.. NOT pay the $1000 Fee, and continue to sell kratom in this State?
I mean, should be interesting to see the AKA, their KCPA, with different laws in every different State (and County!) with different penalties in each State, trying to ENFORCE their laws under threat of Lawsuit, Penalty, including Search and Seizure of kratom by the State Police? Who's gonna be the first Online Vendor... to be raided by Oregon State Police, and have their kratom seized?
FORCE the People of Oregon, to ONLY buy their kratom from a "Registered" Retail Head Shop?

- (2) (a) The department shall by rule create procedures for registering a kratom product under this section.
(b) The rules described in paragraph (a) of this subsection shall include standards for a registered kratom product, including standards for: - (A) Testing to ensure the kratom product is safe for human consumption; and
(B) Accurate labeling. - (c) The department shall by rule set a fee to register a kratom product.
- (d) The fee described in paragraph (c) of this subsection must be paid by a kratom processor before a kratom product may be registered with the department.
- (3) The department may seize and destroy any unregistered kratom product offered for sale in this state.

Anyone know if the KCPA bills apply to out-of-state vendors shipping to that state? Reading the Oregon text makes me think no.... there are penalties for kratom processors in Oregon who do not register. If you "imported" unregulated kratom from another state you could not legally sell it in Oregon. But I do not see any penalties for non-Oregon kratom processors, unless I am missing something? If I am right, this bill does not impact people ordering kratom online from non-Oregon vendors for personal use?

Important questions there - Seems like people are just "going along" with the silly un-necessary KCPA stuff, without asking these questions? Well...the answers are not simple. Sales of Weed, and or drug paraphernalia, are both illegal under Federal Law.. but remember.. Tommy Chong, got years in prison for selling a Bong over the Internet.walla2wanderer wrote:Anyone know if the KCPA bills apply to out-of-state vendors shipping to that state?
State Law? People had better start reading up... States DO have Long Arm laws. Which means, YOU or your business, CAN be sued in your state for violating another state's LAW. Even worse... the AKA and their head-shop Attorneys, have now put specific language in the KCPA, as follows: Section 4 - an individual may bring a civil action for damages resulting from a violation of sections 1 to 6 of this 2019 Act, including economic or noneconomic damages.
The way I read that? Any Oregon based Vendor, lets say well-known rip-off vendor Kraken / Phytoextractum.. (They are pushing the KCPA in Oregon), CAN legally SUE any Online vendor, claiming they lost business when their customer bought un-regulated kratom from Online vendor.
